The Law Society

Medical claims are usually complex and are often more difficult to prove than other categories of personal injury claims. Our network consists of lawyers who have specialist skills and who are all members of The Law Society clinical negligence panel. A lawyer must be a panel member in order to make an application for legal aid and less than 1% of UK solicitors are franchised to make such an application for public funding of a case.

Panel Membership

In order to become a Law Society panel member a solicitor must submit an application detailing both with his ability and experience and which also outlines the resources and systems available within the firm. To qualify a lawyer must be competent in the following:

  • drafting documents used in court, by experts and by counsel
  • research of legal and medical issues
  • assessment of potential damages payment
  • calculation of interest that may be payable on awards of damages
  • selection and use expert witnesses including medical consultants
  • efficient management of the case from start to finish
  • the law relating to vicarious liability and its application
  • the law of negligence particularly in a medical situation
  • liability statutes and law including case law
  • limitation of actions including the Limitation Act
  • personal injury, work and the effect on State benefits
  • European Community legislation
  • the rules of the County Court
  • the rules of the Supreme Court including the Court of Appeal
  • claims arising from the death of a potential claimant
  • the relevance of National Health Service
  • National Health Service structure
  • indemnity rules relating to complaints
  • medical defence bodies including insurance companies and Unions
  • private health care
  • Community Health Councils
  • knowledge of medical terminology

The Law Society Consumer Complaints Service

Most people are pleased with the way in which a solicitor has handled their claim however in the unlikely event that you are dissatisfied with the solicitors work it is possible to have the complaint considered by The Consumer Complaints Service which is the part of the Law Society. The Consumer Complaints Service attempts to find a solution to the complaint and may advise you on how to deal directly with the solicitor or may raise the problem with the solicitor on your behalf. It is anticipated that 75% of complaints will be resolved within six months of intervention by The Consumer Complaints Service.
