General Damages. This category represents compensation for items that cannot be calculated accurately and includes past pain and suffering and ongoing pain and discomfort if there is a continuing disability.
Special Damages. This category represents compensation for items that can be calculated accurately and includes wages losses, both past and future, and all other reasonable expenses incurred by the claimant as a result of the injury.
Interest
In addition to compensation for personal injury there is often an element of interest that can be claimed which is based on the amount and type of the basic award. Awards can also me made in the form of a weekly, monthly or annual payment known as a structured settlement however this type of award is usually only made in high value cases with specific parameters that may make payment of a lump sum unfair.
